System Use Consent

This Platform is operated by 10x National Security Inc. (10xNatSec) as the sole consortium manager of the Intelligence Community Data Consortium (ICDC). Each User must review, electronically sign, and accept this Platform Agreement before access is permitted. This Platform Agreement governs Platform access and use. Before a User accesses any Vendor Data, additional terms will be present for review and acceptance. No right, license, or other interest in Vendor Data is granted unless and until an applicable Order Form is executed by the authorized parties. Clicking “I Acknowledge and Accept” constitutes an electronic signature where permitted by Applicable Law.

Terms for Government Users: Vendor Data is owned by the applicable Vendor and is provided on an “as-is” basis as to data quality. No right, license, or other interest in Vendor Data is granted unless and until an applicable Order Form is executed by the authorized parties. Before accessing Vendor Data, a Government User must review and accept any additional license terms presented for that data. If an executed Order Form expressly grants Government Purpose Rights, those rights are limited to authorized Government purposes, including use by Authorized Users and Government Support Contractors acting for those purposes, and do not permit commercial use, public disclosure, transfer of ownership, or disclosure to persons other than permitted Authorized Users and Government Support Contractors. Government Users shall comply with Applicable Law, this Platform Agreement, any applicable executed Order Form, and license terms. Government Users shall not reverse engineer, circumvent controls, introduce Harmful Code, or use the Platform for any unauthorized purpose. No Vendor Data may be accessed unless the applicable Government Customer has an active, paid, and properly funded Order Form that identifies the Vendor Data and enumerates the authorized Users and any permitted Downstream Users. Nothing in this Platform Agreement imposes an indemnification obligation on the United States Government or any Government Customer; waives sovereign immunity, or obligates funds beyond Applicable Law and available appropriations. 10xNatSec disclaims responsibility for Vendor Data, Vendor products, Vendor performance, and decisions made using Platform outputs. Continued use after execution of this Platform Agreement constitutes acceptance of the then-current terms.

Users shall use all Platform features, including any chat agent or artificial-intelligence-enabled capability, only for authorized and intended purposes and shall not circumvent Platform guardrails, security controls, access restrictions, or safety measures, including through prompt injection, jailbreak attempts, malicious code, unauthorized data extraction, or other harmful or unauthorized activity. 10xNatSec may restrict or terminate access and may report suspected hazardous, dangerous, unlawful, or security-threatening activity to appropriate authorities.

Terms for Vendor Users: Vendors and their Users may access the Platform only to list, administer, support, and use that Vendor’s Vendor Data and Vendor products as authorized under this Platform Agreement, including the Vendor Users section, and any applicable executed Order Form and related documents. Each Vendor User must sign and accept this Platform Agreement before Platform access. Vendors remain responsible for their Users, listings, data, products, and order performance, and no Vendor User may access Government Customer data, another Vendor’s non-public data, or the Platform for an unauthorized or competitive purpose.
